(In 2009) This is a list of Foundation Trusts that are or have been, according to Monitor, in significant breach.
- HEATHERWOOD AND WEXHAM PARK HOSPITALS NHS
FOUNDATION TRUST (the Trust)
The Board confirmed that it had received the report of Edward Lavelle, Regulatory Operations Director, in relation to the Trust.
In July 2009, Monitor’s Board had determined the Trust to be in significant breach of the terms of its Authorisation due to a failure to operate efficiently, effectively and economically.

- University Hospital of South Manchester NHS Foundation
Trust
The Board’s attention was drawn to the Trust being in significant breach in relation to a range of governance concerns.
- Gloucestershire Hospitals NHS Foundation Trust
Following Edward Lavelle’s presentation of the circumstances at the Trust and questions from the Board, the Board confirmed that the Trust was in significant breach of its terms of Authorisation relating to compliance with health care and other standards and a general duty to exercise its functions effectively, efficiently and economically.
- Colchester Hospital University NHS Foundation Trust
The Board was advised of the circumstances surrounding serious performance issues and other wider governance concerns at the Trust, notwithstanding progress made.
Monitor’s Board concluded that the Trust was in significant breach of terms of its Authorisation due, in summary, to its failure to comply with healthcare standards, to exercise its functions effectively, efficiently and economically, to co operate with other NHS bodies or to deal with Monitor in an open and co-operative manner.

- AINTREE UNVIERSITY HOSPITALS NHS FOUNDATION TRUST
Edward Lavelle, Regulatory Operations Director, explained the current position with the Trust.
The Trust’s performance in relation to C.Difficile had triggered the three ambers
to red rule and, in addition, the Trust had previously been subject to the accelerated escalation process for concerns with the high number of C.Difficile cases and the potential that its response to the failure to meet targets may indicate governance
concerns. Following a formal meeting with the Trust in June, Monitor had written to the Board setting out its concerns including that the Board had placed too much reliance
on external assurance and that it had not taken timely and effective action to address the situation relating to its C.Difficile performance and its ongoing failure to meet its contractual obligations. The Trust’s response to these concerns had not identified any material issues which mitigated these concerns.
The Board resolved that the Trust was in significant breach of its Authorisation for governance concerns related to failures to identify and then to satisfactorily address the risk of breaching its C.Difficile target.

- Durham and Darlington NHS Foundation Trust
The Trust was in significant breach of its Authorisation and the executive should agree a trajectory for MRSA cases in 2009-10 with the Trust by which to assess if it had taken adequate steps to rectify the position.
The Board also requested that the PCT be notified by Monitor at the same time as writing to the Trust.
- North Lincolnshire and Goole NHS Foundation Trust
The Trust was in significant breach of its Authorisation and the executive should agree a trajectory for MRSA cases in 2009-10 with the Trust by which to assess whether it had taken adequate steps to rectify the position.
The Board also requested that the PCT be notified by Monitor at the same time as writing to the Trust.
- Royal National Hospital for Rheumatic Diseases NHS
Foundation Trust.
The Trust was in significant breach and under s52 of the 2006 Act the Board.
